Terms and Conditions

Last updated: 2024

These Terms and Conditions ("Terms") govern the use of the website operated by Clearlifeinsight and the ordering of home food delivery services made available through it. By placing an order or otherwise using this website, you agree to be bound by these Terms. If you do not agree, please do not use the website or place an order.

1. Who We Are and How to Contact Us

This website is operated by Clearlifeinsight, a home food delivery service based in the United Kingdom.

References to "we", "us" or "our" mean Clearlifeinsight. References to "you" or "your" mean the customer using our website or services.

2. Placing and Confirming an Order

Orders may be placed through our website by selecting the desired meals, delivery date and delivery address, and completing the checkout process. An order constitutes an offer by you to purchase the selected items, which we are free to accept or decline.

A contract between you and Clearlifeinsight comes into existence only once we have sent you an order confirmation by email or displayed a confirmation on the website following successful payment. We reserve the right to refuse or cancel an order, for example where an item is unavailable, where there is a suspected error in pricing or description, or where delivery to your address is not possible.

Please check your order carefully before completing checkout, in particular delivery address, delivery date and any dietary or allergen preferences, as these details are used to prepare and dispatch your order.

3. Prices, Payment and What Is Included

All prices displayed on the website are shown in pounds sterling (GBP) and, unless stated otherwise, are inclusive of any applicable value added tax (VAT). Delivery charges, where applicable, are shown separately at checkout before you confirm your order.

The price you pay is the price displayed at the time your order is confirmed. We take reasonable care to ensure prices are correct, but in the event of an obvious pricing error we may cancel the affected order and notify you.

Payment is taken at the time of ordering through the payment method offered at checkout. Full payment must be received before an order is dispatched for delivery. The order confirmation will set out what is included in the price, such as the meals selected, packaging and any delivery fee.

4. Cancellation and Complaints

You may cancel an order free of charge by contacting us at info@clearlifeinsight.com before it has been dispatched for delivery. Once an order has entered preparation or been dispatched, cancellation may no longer be possible due to the perishable nature of food products.

As the goods supplied are food items that are perishable and may deteriorate or expire rapidly, the statutory right to cancel that ordinarily applies to distance contracts under UK consumer law does not apply once such goods have been delivered.

If you receive an order that is incorrect, damaged, or otherwise unsatisfactory, please contact us as soon as possible, and in any event within 24 hours of delivery, at info@clearlifeinsight.com or +44 141 380 6572. We will investigate the matter and, where appropriate, offer a replacement, credit or refund. This does not affect your statutory rights under the Consumer Rights Act 2015, including the right to goods that are of satisfactory quality, fit for purpose and as described.

5. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under English law.

Subject to the above, our total liability to you arising out of or in connection with an order shall not exceed the amount you paid for that order. We shall not be liable for any indirect or consequential loss, including loss of income or loss of enjoyment, arising from use of the website or delivery services.

We are not responsible for delays or failures in delivery caused by circumstances beyond our reasonable control, including adverse weather, traffic disruption or third-party courier failures.

6. Cookies and Advertising

This website sets a single cookie, named cookie_consent, which stores your cookie consent preference for a period of one year. No analytics, tracking or session cookies are used on this website.

Advertising measurement is only activated after you have given consent, and it operates solely on the order confirmation page, once your order has been placed.

7. Data Protection

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Details of how we collect, use and protect your personal data are set out in our separate Privacy Policy. If you have concerns about how your data is handled, you may contact us at info@clearlifeinsight.com or lodge a complaint with the Information Commissioner's Office (ICO), the UK's independent supervisory authority for data protection.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms or your use of the website shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protections applicable in your place of residence within the United Kingdom.

9. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or applicable law. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
